O novo marco regulatório do pré-sal : o processo legislativo e as controvérsias existentes no marco consolidado

Abstract

Este estudo realiza uma reconstrução histórica da tramitação dos projetos que envolvem o novo marco regulatório do Pré-Sal, objetivando identificar as principais controvérsias debatidas durante o Processo Legislativo do novo marco. O trabalho contempla as discussões surgidas ou ignoradas durante o processo legislativo analisado, de modo a oferecer um panorama sob o ponto de vista jurídico da formação de um novo marco regulatório de um setor tão importante da indústria brasileira. Espera-se, com isso, identificar sob que condições o debate que culminou com a formulação do novo marco regulatório do pré-sal se desenvolveu no Poder Legislativo e quais os reflexos deste novo marco no mundo jurídico que envolve o setor petrolífero. O resultado esperado é identificar como as questões jurídicas se manifestam e se desenvolvem durante a tramitação de projetos de lei no Legislativo – cuja discussão tem caráter eminentemente majoritário e político – e, ao final, identificar e analisar dois dos pontos controvertidos que permanecem no marco já consolidado: a constitucionalidade do contrato de partilha e o papel da Pré-Sal Petróleo S.A. no novo modelo. _______________________________________________________________________________ ABSTRACT

This study undertakes a historical reconstruction on the development of the proposed bills related to the new regulatory framework for Pre-Salt Oil, aiming to identify the main controversial debates during the legislative process of such new regulatory framework. The work herein addresses the discussions arisen or forsaken during the legislative process, so as to provide an overview of the legal aspects related to the construction of such an important regulatory framework for the Brazilian industry. It is intended by this work to identify what were the conditions in the Legislative Chambers under which the discussions over the new Pre-Salt Oil regulation have been developed, as well as what are the legal reflexes of such new regulatory framework to the Oil & Gas sector. The expected results are the identification of how the legal aspects arise and develop during the ordinary course of bills discussion in the Legislative Chambers – which are generally based under instruments of political and majoritarian will rather than technical legal arguments –, and, finally, the identification and analysis of two controversial aspects that still remain in the consolidated regulatory framework: the constitutionality of the new oil production sharing agreements and the role of the company Pre-Sal Petróleo S.A. pursuant to the new regulation model.
