| Resumo: | O Projeto do Novo Código de Processo Civil trouxe, dentre suas inovações, o Incidente de Resolução de Demandas Repetitivas. Com declarada inspiração no Musterverfahren, instituto do direito alemão, o Incidente é um instrumento de tutela coletiva que possibilita a centralização do julgamento de demandas que versem sobre questões jurídicas semelhantes em um só tribunal. Dessa forma, contribui para a consecução dos ideais de justiça célere e eficaz, bem como contribui para a manutenção da uniformidade da jurisprudência no país. O presente trabalho objetiva questionar a dita inspiração no Musterverfahren, verificando a extensão de sua influência na criação do Incidente por meio da busca de significativas semelhanças entre os dois institutos. Para tanto, o Incidente de Resolução de Demandas Repetitivas e o Musterverfahren serão, em um primeiro momento, estudados separadamente. Em um segundo momento, serão confrontados por meio da análise de seus pontos de divergência e pontos em comum. Os dados apresentados no presente trabalho permitirão concluir que a aparente inspiração no direito alemão é fraca e inconsistente. ________________________________________________________________________________ ABSTRACT
The Bill of Law for the New Brazilian Civil Procedure Code brought, among its innovations, the Repetitive Claims’ Resolution Incident (“Incidente de Resolução de Demandas Repetitivas”). Professedly inspired by the Musterverfahren, a German Law institute, the Incident is a collective litigation instrument that allows the centralization of trials of claims that deal with issues of similar legal nature, in just one court. In this fashion, it contributes to the achievement of the ideals of expeditiousness and effectiveness present in the Brazilian Constitution, as well as to the maintenance of the uniformity in the country´s legal precedents. This paper aims to question the so-called inspiration in the Musterverfahren by verifying the extent of its influence on the actual creation of the Repetitive Claims’ Resolution Incident through analyzing significant similarities between the two institutes. Therefore, the Incident and the Musterverfahren will be, at first, independently examined. Then, they will be juxtaposed to highlight their differing points, as well as the similarities present in both texts. The data presented in this work will elucidate that the apparent inspiration in the German Law is weak and inconsistent. |
