A atuação das organizações não governamentais na Corte Interamericana de Direitos Humanos

Abstract

Há algum tempo as Organizações Não Governamentais – ONGs - têm travado uma verdadeira batalha para consolidarem-se externamente como sujeitos de direito internacional. A Organização dos Estados Americanos – OEA -, mais especificamente a Corte Interamericana de Direitos Humanos – CIDH - tem sido essencial nesse processo de consolidação desses sujeitos ao abrir espaço para que essas entidades participem do processo decisório e de construção do direito internacional. Este trabalho parte de uma análise das ONGs enquanto sujeitos internacionais e busca explicar a importância dessas entidades não apenas no ambiente jurisdicional das Organizações Internacionais, mas também nos ambientes não jurisdicionais, porém igualmente importantes para o direito internacional. O trabalho passa ainda por uma análise do funcionamento do sistema interamericano de proteção dos direitos humanos – especificamente a CIDH e a Comissão Interamericana de Direitos Humanos – e por último tenta, com aquilo que foi construído no trabalho, elaborar algumas críticas ao relacionamento entre as ONGs e a CIDH; levantando pontos positivos e negativos desse envolvimento. __________________________________________________________________________________ ABSTRACT

For a while, Non Governamental Organizations – NGO – have been engaged on a battle for their external consolidation as subjects of international law. The Organization of American States – OAS -, specifically de Inter American Court of Human Rights – IACHR – have been fundamental in this process of consolidation of thoses subjects by opening space to those entities to participate in the decision-making process and the construction of international law. This piece begins with an analysis of the NGOs as internationals subjects and tries to explain their importance not only in the jurisdictional environment of the International Organizations, but also on the equally important non-jurisdictional international legal environments. The paper also makes an analysis of the functioning of the Inter-American Human Rights system – specifically the role played by the IACHR and the Interamerican Comission of Human Rights. Finally, it brings some criticism on the relationship between NGOs and the IACHR; underlining up the positives and the negatives sides of such envolvement.
