| Resumo: | O presente trabalho tem por objetivo analisar o julgamento do Supremo Tribunal Federal acerca da união homoafetiva à luz da Teoria Constitucional. Primeiramente, far-se-á breve contextualização histórica do debate dos direitos LGBTs, perpassando pelas conquistas no âmbito do judiciário e discussões na esfera do legislativo. Em seguida, será feita importante conceituação de termos como ativismo judicial e judicialização da política. Por fim, será analisado o julgamento da ADPF nº 132 e ADI nº 4277 à luz da teoria normativa de Ronald Dworkin. |
| Abstract: | This study aims to analyze the judgment of the Federal Supreme Court about the same-sex union according to the Constitution Theory. At first, it will be done a brief historical contextualization of the debate on LGBT rights, going through the achievements at the judiciary level and the discussions in the legislative sphere. Next, it will be done an important conceptualization of terms such as judicial activism and judicialization of politics. Finally, it will be analyzed the judgment of ADPF nº 132 and ADI nº 4277 in light of Ronald Dworkin’s normative theory. |
