A busca da verdade real como uma estratégia retórica : a legitimação do poder punitivo através da promessa de segurança jurídica

Abstract

O presente trabalho tem como objetivo analisar a busca da verdade real dentro do processo penal sob uma perspectiva retórica, desnaturalizando tal conceito que é apresentado como uma realidade em si, como se de fato existisse uma verdade real a ser descoberta pelo magistrado e pelo processo. Objetiva-se, assim, evidenciá-la como uma construção discursiva, que só é possível na medida em que se assenta em valores compartilhados pela sociedade contemporânea; e mostrar que, por fim, ao conceder iniciativa probatória ao juiz, ela compromete qualquer imparcialidade que se pretende sustentar, fundando uma estrutura nitidamente inquisitiva. Para tanto, adotar-se-á uma visão retórica do mundo, na qual não existe nada que esteja fora e seja independente do próprio ser humano e, portanto, da linguagem, meio pelo qual ele constrói a sua própria realidade, que será, portanto, sempre artificial. Isto porque mostra-se incapaz de ter acesso a qualquer realidade que esteja fora do seu universo linguístico. A partir, então, da negação de uma noção de verdade, como algo natural e universal, buscar-se-á mostrar como esse discurso é uma estratégia retórica que, ao ocultar os mecanismos ideológicos que o sustentam e ao oferecer uma promessa de segurança jurídica, permite ao poder punitivo legitimar-se. _____________________________________________________________________________ ABSTRACT

The present work aims to analyze the search of real truth in the criminal procedure, through a rhetoric perspective, denaturalizing this concept which is presented as a reality in itself, as if, in fact, there was a real truth to be discovered by the magistrate and the procedure. The objective is to present the truth as a discursive construction that is only possible when there is a sharing of values among this society; and, finally, to demonstrate that the attribution of a probationary initiative to the judge endangers any impartiality that one pretends to support, founding a structure crisply inquisitive. For this purpose, it will be adopted a rhetoric vision of the world, in which there is nothing that is independent or outside the human being and, thus, the language, means whereby he constructs his own reality that will always be artificial, once he is incapable of accessing any reality that is outside his linguistic universe. Then, starting from the negation of the notion of truth as something natural and universal, it will be demonstrated how this discourse is a rhetoric strategy that concealing its ideological mechanism and offering a promise of jurisdictional security allows punitive power to legitimate itself.
