Regime ambiental internacional e responsabilidade de proteger : justificativas para uma intervenção ecológica na Amazônia?

Abstract

A ideia que a Amazônia está em perigo povoa a mente dos brasileiros desde os tempos coloniais. Atualmente, o debate sobre a internacionalização da Amazônia ou relativização sobe a soberania na região. O propósito deste artigo é analisar se os conceitos de Regime Ambiental Internacionale da Responsabilidade de Proteger podem servir dejustificativas para uma Intervenção Ecológica na Amazôniae se há indícios de que seja utilizado no curto prazo.Examinar-se-áa construção do Regime Ambiental Internacional e os conceitos de Responsabilidade de Proteger e Jus ad Bellumconfrontando-os com o de Soberaniae verificando a legalidade da Intervenção Ecológica à luz da legislação atual. A securitização do debate e a invocação do princípio da Precaução serão estudados, assim como as perspectivas dealguns dos grupos de interessemais importantes –militares, políticos, cientistas, ambientalistas e pesquisadores. ______________________________________________________________________________ ABSTRACT

The idea that the Amazonian is in danger populates the mind of the Brazilians since the colonial times. Now, the debate about the internationalization of the Amazonian or relativization goes up the sovereignty in the area. The purpose of this article is analyze the concepts of International Environmental Regime and of the Responsibility of Protecting can serve as justifications for an Ecological Intervention in the Amazonian and there are been indications that is used in the short period. It will be examined the construction of the International Environmental Regime and the concepts of Responsibility of Protect and Jusad Bellumconfronting them with the one of Sovereignty and verifying the legality of the Ecological Intervention to the light of the current legislation.The securitizationof the debate and the invocation of the beginning of the Precaution will be studied, as wellas the perspectives of some of the groups of more important interests, likemilitary, political, scientists, environmentalists and researchers.
