| Resumo: | O presente trabalho discute o direito de voto por parte de estrangeiros e seu impacto na proteção a refugiados, em especial na América Latina. É realizada uma revisão de literatura sobre a relação entre soberania, nacionalidade e cidadania, assim como a apresentação dos mecanismos de proteção a refugiados na região abordada. Ao discorrer sobre as condições humanas propostas por Hannah Arendt, é apresentada a importância da participação política na vida humana, e como a privação de tal direito pode ser nociva a refugiados. A teoria de Hannah Arendt é aplicada sobre o Regime Interamericano de Proteção a Refugiados, concluindo que, apesar dos avanços na proteção, o direito a voto não é assegurado a tal população nos tratados e convenções regionais, o que prejudica não só a sua integração local, como também reprime características básicas do ser humano. _________________________________________________________________________ ABSTRACT
This work discusses the right to vote by foreign people and its impact on the protection of refugees, especially in Latin America. This study presents a review of the literatures about the relation between sovereignty, nationality and citizenship, as well as a presentation of the refugee protection mechanisms in the selected region. While the discussion about the human conditions proposed by Hannah Arendt, it is presented the importance of political participation in human life, and how the privation of that right can be harmful to refugees. Hannah Arendt’s theory is applied to the Inter-American Refugee Protection Regime, concluding that, although there have been some improvements on the protection, the right to vote is not assured for this population in the regional treaties and conventions, which damages not only the local integration, but also suppresses basic attributes of a human being. |
